A few pointers

If you have never gone through a divorce before the whole thought of it can be very daunting so here are a few points which we frequently get asked to help light the way on:

What first? If you have children, the first thing you will want to get clear in your heads is how you will arrange things for them, in the short and the long-term. I think we can all agree this is vital and non-negotiable.

Don’t rush off to solicitors, if things are amicable and you both pretty much know what is needed then save your money for your new lives. Separate solicitors are not needed if things are amicable and you both know pretty much what needs to be done and you are in agreement.

Be aware that by divorcing without putting into place a financial agreement (consent order) that there is no time limit for making a financial claim, even many years after the final divorce. You may feel confident right now that your spouse would never make a financial claim against you, but circumstances can change in the future. For example, one of you may become ill and unable to work or one of you may receive an unexpected inheritance or may win the lottery. Things can change in the future which may result in one making an unforeseen claim against the other for money if this door has not been closed.

It will take a while for the divorce to go through as it is a 3 stage process with timescales dictated by how busy the court is. The good news is that your Divorce Manager will be handling the whole thing so you can get on with your life.

There are no rewards for good behaviour or punishments for bad. What happens to the money isn’t affected by who had an affair, or who did what. The whole process is private so there is no naming and shaming. We offer a personal and confidential service, we have heard it all before and it stays with us.

There are no set formulas for working out who gets what. Your Divorce Manager will help you both agree between you a settlement that is fair, reasonable and needs based if there are assets involved.

To divorce you must:

  • Have a permanent home here.
  • Have been married for at least a year.
  • Have grounds for divorce, from the following:
    • 2 years separation
    • 5 years separation
    • Unreasonable behaviour
    • Adultery
    • Desertion

Stage 1) Divorce Petition

We complete the above on your behalf with the necessary information gained from the person instigating the divorce (Petitioner) to ensure that it is accepted first time as it must be exactly right to avoid “ping pong” post.

A court fee of £593.00 may apply, check our calculator below to see if you are eligible not to pay.


Once processed by the court, you will both receive a copy of the divorce petition and an Acknowledgement of Service will also need to be completed by your spouse (Respondent) but again we will complete this on their behalf and file it with the court.

Stage 2) Apply for Decree Nisi

Once the completed Acknowledgement of Service Form is received back to the Petitioner we would then apply for your Decree Nisi. A judge would need to be satisfied that the marriage has broken down – to date, we have never had a request denied so again we would take care of all of this for you. If a judge is agreeable, the Decree Nisi will be pronounced a few weeks later and you will both receive a Decree Nisi certificate.

Stage 3) Decree Absolute

We would apply for the final stage of the divorce, as soon as permitted which is six weeks and one day after the Decree Nisi is pronounced. Once processed by the court you will both be notified that your marriage has been dissolved enabling you both to remarry if you wish.

Important note: Here at The Divorce Manager, we don’t think you should end up paying twice so if we have already help with your Separation Agreement the cost will be deducted off your divorce if you also require a consent order. Also, you will never, ever, be rushed. We understand that conversations need to take place so we will be here waiting ready to help where needed.

Financial Agreement (Consent Order)

If you have assets to protect and/or you wish to close the door on future claims against each other we will start working with you both on this at the point the Divorce Petition is at court.

What is in the “matrimonial pot?”
We work with you both to understand your finances and guide you to an agreeable settlement that is workable now and in the future to meet both of your needs and those of any children.

Who gets the house, who gets the pension?
Once we understand what you have and who needs what we can formalise the details into a legally binding consent order that sets out your current financial position and your positions post divorce which will need to meet with the approval of a judge as being fair, reasonable and needs based.

What is a Divorce Manager?
